These terms and conditions of use (the “Terms and Conditions”) outline the rules and regulations for the use of Beach Enclave’s (“Beach Enclave”) website, located at beachenclave.com (the “Website”).
By using or accessing the Website and by explicitly accepting these Terms and Conditions when prompted during the booking or account creation process, you accept and agree to be bound and comply with these Terms and Conditions and our Privacy Policy, available here beachenclave.com. Do not continue to use or access the Website if you do not agree to the Terms and Conditions stated on this page.
The following terminology applies to the Terms and Conditions and Privacy Policy: “Client”, “You” and “Your” refers to you, the person using the Website and bound by Beach Enclave Terms and Conditions. “Ourselves”, “We”, “Our” and “Us”, refers to Beach Enclave. “Party” or “Parties” refers to both the Client and Beach Enclave. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of the provision of Beach Enclave’s stated services, in accordance with and subject to the prevailing laws of France.
For the purposes of these Terms and Conditions:
- A ‘Consumer’ shall mean any individual acting for purposes which are outside their trade, business or profession, in accordance with Article L.221-1 of the French Consumer Code.
- A ‘Professional’ shall mean any individual or legal person acting for purposes relating to their trade, business or profession.
Where applicable, certain clauses of these Terms and Conditions shall apply exclusively to Consumers and will be clearly identified as such.
Unless the context otherwise requires, words importing the singular include the plural and vice versa, words importing gender include all genders or the neuter, words importing the neuter include all genders, and capitalized words and uncapitalized words are taken as interchangeable.

Modifications

Users who do not accept the modifications shall have the right to terminate their use of the Website and/or their account without penalty. The Website and the information and material contained therein may be changed, withdrawn or terminated at any time in our sole discretion with reasonable notice and provided such changes do not impair any ongoing commitments towards Consumers or confirmed bookings. We will not be liable if, for any reason whatsoever, all or any part of the Website is restricted to users and/or unavailable at any time or for any period.

All prices displayed on the Website which relate to any products or services are inclusive of all fees, levies, service charges, surcharges, taxes, and other charges. To the extent permitted by applicable law, we shall not be held liable for the content of advertisements or offers originating from third parties, including those displayed on or accessible via our Website.All prices indicated on the Website for Consumers located in France shall be displayed in euros and include all applicable taxes (including VAT), fees, and mandatory charges, in compliance with French consumer law. This includes, where applicable, the indication of the total price prior to confirmation of any booking or service order, in accordance with French consumer law.

Unless otherwise stated, Beach Enclave and/or its licensors own the intellectual property rights for all material on the Website. All intellectual property rights are reserved by Beach Enclave. To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Beach Enclave, its affiliates, and their respective directors, officers, employees, agents, service providers, contractors, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) resulting directly from (i) your material breach of these Terms and Conditions, or (ii) illegal use of the Website or its content in violation of applicable law or of third-party rights
Governing Law and Jurisdiction
The Website and these Terms and Conditions will be governed by and construed in accordance with the laws of France applicable therein.
Any action or proceeding arising out of or relating to this Website and under these Terms and Conditions will be instituted in the competent French courts.

Booking or Rental Services
Beach Enclave acts as an intermediary in the booking of furnished accommodations or travel services and is likely to qualify, for clients residing in France, as a travel operator (“opérateur de voyages ou de séjours”) within the meaning of Articles L.211-1 and following of the French Tourism Code.
Pursuant to Article L.211-1 and following of the French Tourism Code, Beach Enclave undertakes to:
- - Provide clear and accurate precontractual information on the rental (description, location, duration, price, conditions);
- - Ensure that it has the necessary professional liability insurance and financial guarantee required under Articles L.211-16 and R.211-35;
- - Provide the consumer with a booking confirmation summarizing the essential information of the rental contract.
Right of withdrawal
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to the provision of accommodation services intended for a specific date or period. However, if the booking concerns services not linked to a specific date or period, or involves ancillary services unrelated to accommodation (e.g. gift cards, optional extras), consumers located in France benefit from a 14-day withdrawal period starting from the conclusion of the contract.
